Auction Terms:

• Rough-Trade Auctions are open to any registered user of one of the Untied Artists Websites, for private and commercial sales.
• The auction function as offered only acts as a vehicle for buying and selling of items, and such transactions are strictly between the buyer and seller.
• We will not support, promote or allow merchandise
  • which is intangible like services,
  • merchandise which requires special licensing for sale including but not limited to; prescription drugs, firearms, alcoholic beverages, products which are inherently dangerous or illegal,
  • or pornographic material that may be, or imply being, underage or non-consensual,
  • or products that cause damage, seek revenge, wreak havoc, be malicious,
  • or that promote hatred, racism or violence.
• Attempting to promote any such items may lead to prosecution internationally and/or in your state / country or residence.
• Sellers are responsible for correctly describing the items, and Rough-Trade, Untied-Artists or their agents cannot be held legally responsible, or liable in any way for fraud, theft, misrepresentation or any loss suffered by either buyer or seller in anyway.
• Once an item has been placed on auction, the record cannot be altered, manipulated or removed by any user. If an item is deemed inappropriate or at the request of the seller, an item may be withdrawn or removed from the auction by the site administrators only.
• Items may only be withdrawn from the auction BEFORE the final closeout time is reached.
• An item placed up for auction will remain so for a period of 14 days over which period registered users may tender bids for the item/s.
• Any user who bids on an item should consider that offer a legally binding offer to purchase the item at that price.
• Any bidder who has tendered the highest price, and should that price exceed the reserve price at the close of the auction, will be liable for payment of that amount to the seller. Should this bidder fail to meet their obligation, they may be liable for legal proceedings, they will have their access to the Untied Artists sites curtailed and their details will be made public as being dishonest and/or untrustworthy.
• Any bidder who either threatens or cajoles another bidder or bidders into some form of collusion or consortium to artificially manipulate the bidding will be considered as dishonest, and should they be reported they will have their access to the Untied Artists sites curtailed and their details will be made public as being dishonest and/or untrustworthy.
• Once a bid on an item has been placed, the record cannot be altered, manipulated or removed by any user. At the request of the seller, a bid may be withdrawn or removed from the auction by the site administrators only.
• Bids may only be withdrawn from the auction BEFORE the final closeout time is reached. Once an item reaches the closout time and the sale is closed all bids are considered final and the person with the highest bid which exceeds the reserve price will be liable for the purchase. The only recourse is for the buyer to settle the amount with the seller and imediatly place the item up for auction again.
• Any item that is unsold after this period will be removed, no charges will be raised against the seller, and the item may be re-submitted for sale should the seller wish to do so.
• Sellers will be billed an admin fee of 7.5% of the final selling price (excluding shipping / insurance / misc charges) for any completed transactions, which renders artificially bidding on your own goods to inflate the price, not in your best interests.
• Financial transactions for goods sold are conducted directly between the buyer and seller. On completion of a sale, the parties email addresses and cellphone numbers are forwarded and it is up to them to complete the financial transaction between themselves.
• A bill is raised for 7.5% of the final selling price and is forwarded to the seller for settlement within 7 days. Failure to settle promptly may lead to legal action being taken, access and privileges on all the Untied Artists websites will be curtailed, as well as your details being made public as being dishonest and or untrustworthy.
• By offering or bidding on any items on this site you accept full liability, full responsibility and agree to these terms and conditions.
• Abuse of this site, it's users, servers or application in any way shape or form, will be reported to the relevant authorities, including ISP's and domain managers.
